Documentation comes before field work
The starting file should include the signed agreement creating the security interest, proof of default, title or lien records, a precise collateral description and the requesting party’s identity. Names and serial numbers must agree across the documents. If ownership is disputed, the lien is unclear or a court order is required, the client may need legal advice before a recovery assignment can proceed.
We do not decide contested legal rights or use repossession as a shortcut for a personal property dispute.
The collateral must be specific
A valid assignment identifies the actual vehicle, boat, trailer or equipment to be recovered. Phrases such as “everything on the property” are not an operational description. VINs, hull numbers, serial numbers, titles and schedules attached to the agreement help distinguish secured collateral from property belonging to the debtor or another party.
Attachments and contents should be addressed separately rather than assumed to follow the primary asset.
Acceptance is case by case
A private lien file may require more review than an institutional assignment because the documents and parties vary widely. We can explain what information is needed for operational review, but we cannot provide legal advice or guarantee acceptance. Field activity only follows a file that is sufficiently documented and suitable for lawful recovery.
